<title>FSP Advocacy Update - March 3, 2025</title>

<description><![CDATA[Those of you who attended the very successful FSP convention in Orlando several weeks ago, were informed of the threat of legislation proffered by another physician specialty which initially would have adversely affected the financial viability of many of our pathology practices.  This has been a battle we have fought for decades against the insurance industry, but never against another professional medical Society. Furthermore, this legislation would have potentially dictated pathology billing practices, procedures, codes and/or fee amounts. Your FSP Leadership team along with CAP leadership and advocacy staff spent many hours in virtual meetings with the Florida Academy of Dermatology without satisfaction that we could resolve our differences. Thankfully, through our work with the Florida Legislature and continued negotiations between our lobbyist and those representing dermatology,  we are grateful to share that the Academy withdrew their efforts before the 2025 Legislative Session was set to convene on March 4th. The FSP extends sincere gratitude to our lobbyist, Amy Young for her tireless efforts and unwavering support as well as Steve Weinstein our legal counsel and our trusted partner David Smith at MedReceivables Advisor. In addition, we would like to thank CAP leadership and CAP advocacy staff for participating in the discussions and for their guidance and support on this issue. <br /> <br />Additionally, we thank our FSP members and conference attendees for their generosity and commitment. Florida officially eliminated its status as a swing state with Republican voter registration outpacing Democrats by over 1 million voters and Republicans winning down the ticket with double digit margins in most cases.&nbsp;</p><p style="box-sizing: border-box;">The Legislature will return to Tallahassee on November 19th for an Organizational Session to swear in all new members of the Legislative branch and to officially transition leadership of the chambers. Speaker- Designate Danny Perez (R-Miami) and President-Designate Ben Albritton (R-Bartow) will officially take the helm of their respective chambers and will officially name their leadership teams, committee chairs and committee assignments.</p><p style="box-sizing: border-box;">The Legislature will begin work right away with committee weeks scheduled in early December and throughout January and February of 2025. We fought off efforts on so many fronts including proposals to change the requirements for clinical laboratory directors, reimbursement issues, alternate site testing, and other bills that could potentially impact pathologists.</p><p style="box-sizing: border-box; color: #333333; font-family: 'Helvetica Neue', Helvetica, Arial, sans-serif; font-size: 14px; background-color: #ffffff;">Just as we thought we could breathe after a successful Session, we were again inundated with issues that needed to be addressed at Agency and Cabinet levels. As you recall, we have had continual negotiations with the Agency for Health Care Administration (AHCA) in challenges to the updated fee schedules which did not include PC-CP reimbursement for COVID testing. With many Medicaid Advantage HMOs refusing to pay or otherwise aggressively seeking repayment of large amounts of money paid on COVID testing claims, this has become a year-round effort.&nbsp;</p><p style="box-sizing: border-box; color: #333333; font-family: 'Helvetica Neue', Helvetica, Arial, sans-serif; font-size: 14px; background-color: #ffffff;">Many of you may recall, we had a tough battle with AHCA when they changed its 2020 Practitioner Laboratory Fee Schedule eliminating the professional component on almost 1,000 clinical laboratory tests. The result of our successful efforts saved pathologists in Florida an estimated $15 million. This took a village! On your behalf, the FSP arranged meetings with AHCA staff and drafted numerous letters authored by then FSP President Mort Levitt and FSP officers, as well as Med Receivables COO, David Smith, and FSP Counsel Steve Weinstein.</p><p style="box-sizing: border-box; color: #333333; font-family: 'Helvetica Neue', Helvetica, Arial, sans-serif; font-size: 14px; background-color: #ffffff;">That torch has continued through the 2022 Summer months led by your FSP President, Dr. Jim Zhai and your legislative team, led by Dr. Brett Cantrell. And, again, with invaluable assistance from David Smith and Steve Weinstein as well as FMA former President and FSP member, Dr. Ron Giffler.</p><p style="box-sizing: border-box; color: #333333; font-family: 'Helvetica Neue', Helvetica, Arial, sans-serif; font-size: 14px; background-color: #ffffff;">Once again, we became aware of additional issues with the pathology component of the Medicaid fee schedule, particularly around COVID-related codes. This summer, we realized that these codes were being paid on a global basis as opposed to splitting out the technical and professional components of the fee. This was very unfortunate for many of our independent labs, which are able to stay independent in part because the Florida Medicaid fee schedule has been well-designed to split the PC and TC of the codes without increasing total costs.</p><p style="box-sizing: border-box; color: #333333; font-family: 'Helvetica Neue', Helvetica, Arial, sans-serif; font-size: 14px; background-color: #ffffff;">The result of our letters, virtual meetings, consistent weekly follow-ups, attendance at workshops, etc. resulted in a decision by AHCA to add a PC/TC split to the other Covid codes. Again, this action will result in millions of dollars for the essential role the pathologist plays in health care. Stay tuned as we keep an eye on the 2023 codes!</p><p style="box-sizing: border-box; color: #333333; font-family: 'Helvetica Neue', Helvetica, Arial, sans-serif; font-size: 14px; background-color: #ffffff;"><span style="box-sizing: border-box; font-weight: 700;">CRITICAL CAMPAIGN SEASON</span></p><p style="box-sizing: border-box; color: #333333; font-family: 'Helvetica Neue', Helvetica, Arial, sans-serif; font-size: 14px; background-color: #ffffff;">With the successful conclusion of the 2022 Regular Session, two Special Sessions, and temporary relief from negotiations with AHCA, &nbsp;we are now focusing on the campaign Season. Because of redistricting, we are facing 160 plus races in the Florida Legislature.&nbsp; The FSO Executive Committee has already been busy working with us to determine the seats we hope to defend and selecting newcomers to fill open Seats.</p><p style="box-sizing: border-box; <title>FSP Legislative Update - Welcome to 2022</title>

There is still so much we do not know about how significant issues will unfold.</p><p style="box-sizing: border-box; color: #333333; font-family: 'Helvetica Neue', Helvetica, Arial, sans-serif; font-size: 14px; background-color: #ffffff;">This is also a once-in-decade Session devoted to Reapportionment, which adds an interesting dynamic to every issue when Legislators are often fighting with each other to save their current District configurations. This will affect negotiations behind the scenes throughout the 90-day Session.</p><p style="box-sizing: border-box; color: #333333; font-family: 'Helvetica Neue', Helvetica, Arial, sans-serif; font-size: 14px; background-color: #ffffff;">We will also be revisiting many issues, including step therapy, telehealth, the scope of practice for CRNA’s, PA’s, midwives and possibly optometry, transparency in health care pricing, and many others.</p><p style="box-sizing: border-box; color: #333333; font-family: 'Helvetica Neue', Helvetica, Arial, sans-serif; font-size: 14px; background-color: #ffffff;">Of utmost importance to FSP members will be efforts by the Florida Department of Health to review changes to the clinical laboratory director standards. We also expect the yearly battle on reimbursement for the professional component of clinical pathology. Your FSP Leadership has recently successfully fought changes in reimbursement proposed by the Agency for Health Care Administration, and this issue resurfaces almost annually during the Legislative Session. <title>Update on Cigna Policy on Professional Component for Clinical Pathology</title>

The FSP’s Legislative and Governmental Affairs Committee under the leadership of Chair, Brett Cantrell, MD and FSP President, Qihui “Jim” Zhai, MD, immediately leapt into action to respond to the policy update by engaging committee members and working collaboratively with the College of American Pathologists and the Florida Medical Association to evaluate the proposed policy changes. Subsequently, the FSP submitted a formal letter directly to Cigna, urging them to overturn the proposed policy update.</p><p style="box-sizing: border-box;">In the last week, the FSP has become aware that in response to the efforts of the CAP, the state pathology societies and the individual pathology practices that sent letters, Cigna intends to reverse the proposed policy update and will continue to make payments for the professional component of clinical pathology. A formal announcement has not been made by Cigna, however, should be forthcoming and will be shared with FSP members as soon as it is available. However, as of late, Cigna has reintroduced the policy and intends to discontinue reimbursement of the professional component. The FSP would like to hear from you regarding this policy change. In communication between the CAP and Cigna, Cigna has provided clarification that the updated policy will apply to both employed and non-employed pathologists working in or for facilities that have assumed the financial responsibility through their Cigna contracts for laboratory management and oversight services. In response to this message, the CAP has further pressed Cigna for additional details. Specifically, the CAP asked how Cigna will document its payment to a facility where laboratory management and oversight services are provided through that facility’s contract with Cigna? Further they have asked how a pathologist will clearly determine whether their facilities contracts do or do not result in the new PC of CP claim denials. The CAP requested that Cigna respond to their questions by November 10.
